JJ TECH LIMITED WARRANTY

Subject to the terms of this limited warranty, JJ Tech extends to the original purchaser of equipment manufactured by it and bearing its name, a limited warranty against defects in material or workmanship, provided that the equipment is installed, operated and maintained in accordance with the recommendations and instructions of JJ Tech (the “Limited Warranty”). JJ Tech recommends that corrosion and scaling evaluations be completed before installing its equipment and systems. When applicable, corrosion and scaling inhibitors and/or other appropriate chemicals should be circulated throughout JJ Tech systems via the power fluid.

The Limited Warranty shall be available for a period of one year past the date of purchase, as determined by the invoice date. JJ Tech shall be liable under this Limited Warranty only to the extent that the purchaser submits any warranty claim together with all reasonable supporting documentation and physical evidence supporting such claim within ninety (90) days after becoming aware of such claim, but in any event no later than ninety (90) days after the end of the Limited Warranty period.

JJ Tech will repair or replace, at its option, defective parts without charge if such parts are returned, with transportation charges prepaid, to 5220 Hollywood Avenue, Shreveport, LA 71109 or such other JJ Tech facilities as JJ Tech grants written authorization. Claims under this Limited Warranty must include, where applicable, a report adequately describing the maintenance of the part and the operating conditions under which the claimed part failed, including where applicable, gas and water analysis data documenting the production environment.

THIS LIMITED WARRANTY DOES NOT COVER:

1. Jet pump nozzles, mixing tubes, seals and packing, or any other disposable items.
2. Pumps, including pumps and parts manufactured by Wanner Engineering, electric motors, engines, variable speed drives, and pressure vessels (if any), which are covered by the separate warranties of the manufacturers of these components of JJ Tech systems.
3. Normal wear and/or damage caused by or related to abrasion, corrosion, environmental conditions, cavitation, abuse, negligence, accident, faulty installation or tampering in a manner which impairs normal operation.
4. Transportation costs.
5. Any type of labor or expenses by any party, including JJ Tech, for work performed outside JJ Tech facilities related to a claim under this limited warranty, including but not limited to, labor or expenses to evaluate, repair, uninstall, or reinstall warranted parts.
6. Any failure resulting from modifications or repairs of covered parts not performed or authorized by JJ Tech.

This limited warranty is exclusive, and is in lieu of any other warranties (express or implied) including warranty of merchantability or warranty of fitness for a particular purpose and of any non-contractual liabilities, including product liabilities, based on negligence or strict liability. In no event will JJ Tech’s liability exceed the price paid for the specific product. To the maximum extent permitted by law, every form of liability for direct damage is limited to the limited warranty, and every liability for special, incidental or consequential damages or loss including, without limitation, lost production, loss of wellbore, costs of work-over rigs, tools or tool rental, consultant fees, labor, repair costs, lost revenue and damage to related equipment, is expressly excluded and disclaimed.
